Terms of Service

1. Acceptance of terms

By creating an account or using Vayia ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. What Vayia is

Vayia is a candidate screening tool that allows recruiters and hiring managers ("Recruiters") to create role-specific screening forms, share them with job candidates ("Candidates"), and receive AI-powered evaluations of candidate responses.

3. Account registration

To use Vayia as a Recruiter you must create an account with a valid email address and password. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must be at least 18 years old to create an account.

4. Acceptable use

You agree to use Vayia only for lawful hiring and recruitment purposes. You must not:

• Use the Service to discriminate against candidates on the basis of age, gender, race, religion, disability, sexual orientation, or any other protected characteristic
• Use the Service to collect data for purposes other than candidate screening
• Attempt to reverse engineer, copy, or replicate the Service
• Use automated tools to access the Service without our permission
• Share your account credentials with others

5. Recruiter responsibilities

As a Recruiter you are responsible for:

• Ensuring candidates are informed that their responses will be processed by AI
• Using AI evaluation scores as one input among many, not as the sole basis for hiring decisions
• Complying with applicable employment and data protection laws in your jurisdiction
• The content of screening questions you create

Vayia is a tool to assist hiring decisions. Final hiring decisions remain entirely your responsibility.

6. AI evaluation

Vayia uses artificial intelligence to evaluate candidate screening responses and generate scores, summaries, and recommendations. These evaluations are indicative only and should not be treated as definitive assessments of a candidate's suitability. We make no guarantee as to the accuracy or completeness of AI-generated evaluations.

7. Data and privacy

Your use of the Service is also governed by our Privacy Policy at vayia.app/privacy. By using the Service you agree to the collection and use of data as described there.

8. Beta service and pricing

Vayia is currently in beta and is provided free of charge. Users who create an account during the beta period will retain access to a free tier of the Service even if paid plans are introduced in the future. We reserve the right to introduce paid plans at any time and will notify users in advance of any changes that affect their account.

9. Service availability

We aim to keep Vayia available at all times but do not guarantee uninterrupted access. We may perform maintenance, updates, or changes to the Service at any time without prior notice.

10. Intellectual property

Vayia and its content, features, and functionality are owned by Vayia and are protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

Screening questions and responses created through the Service remain the property of the Recruiter who created them.

11. Limitation of liability

To the fullest extent permitted by law, Vayia shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to hiring decisions made on the basis of AI evaluations.

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.

12. Termination

We reserve the right to suspend or terminate your account if you breach these Terms. You may delete your account at any time by contacting us at privacy@vayia.app.

13. Changes to these terms

We may update these Terms from time to time. We will notify registered users of significant changes by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
